These Terms of Service ("Terms") govern your access to and use of EngageSuite360 (the "Service"), a free-forever CRM operated by Blue Heron Companies LLC, doing business as EngageSuite360 ("Company," "we," "our," or "us"). By creating an account or otherwise using the Service, you agree to be bound by these Terms.
By using EngageSuite360 you confirm that you have read, understood, and agree to be bound by these Terms. If you do not agree, you must discontinue use of the Service immediately. These Terms apply to all visitors, users, and organizations that access or use the Service.
EngageSuite360 is a free, industry-shaped CRM: contacts, companies, leads, deals, pipelines, tasks, calendar, notes, documents, reports, and CSV/Excel import, pre-configured for one of 26 supported industries at signup. The free plan includes unlimited contacts and unlimited team members, with no expiry and no credit card required. Telephony and SMS are metered à la carte on all plans. The free plan deliberately contains no AI. AI Agent-Works — AI employees that answer calls, draft follow-ups, enrich records, and automate browser work inside the same CRM — is an optional paid upgrade offered by our parent platform, AgentWorks Studio, and is governed by its own terms at the point of purchase. We may modify, suspend, or discontinue any part of the Service at any time with reasonable notice.
Free accounts. You may create a free EngageSuite360 account at no cost. Free accounts are subject to the fair-use limits described on this site.
Account security. You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account, and must notify us immediately of any unauthorized access.
Team members. Account owners may invite an unlimited number of teammates to their workspace on the free plan and are responsible for their teammates' compliance with these Terms.
You agree not to use the Service to:
You retain all rights to the contacts, companies, deals, notes, documents, and other records you create in your EngageSuite360 workspace ("Your Data"). You grant us a limited license to use Your Data solely to provide and support the Service. You may export Your Data at any time from your account.
The EngageSuite360 platform — including its software, design, branding, and underlying metadata engine — is the exclusive property of Blue Heron Companies LLC and is protected by intellectual property laws. No rights to the platform are granted to you except as expressly set forth in these Terms.
Where enabled, phone numbers, calls, and SMS are billed à la carte at cost-based, metered rates disclosed at the point of use. These charges apply regardless of plan tier — the free CRM itself is never metered.
The Service is provided "as is" and "as available" without warranties of any kind, express or implied. To the fullest extent permitted by law, Blue Heron Companies LLC's total liability arising out of or relating to the Service shall not exceed the total amount you paid us in the twelve (12) months preceding the claim (or $100 if you are on the free plan). We are not liable for indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities.
You may close your account at any time. We may suspend or terminate your account immediately, without notice, for violations of these Terms or conduct we reasonably believe may harm the Service, our users, or third parties. Upon termination, Your Data remains available for export for sixty (60) days, after which it is deleted in accordance with our data retention practices.
These Terms are governed by the laws of the State of Florida, United States, without regard to conflict-of-law provisions. Disputes arising under these Terms shall be resolved in the state or federal courts located in Pinellas County, Florida.
